AFB Seminar: The Use of Credit Insurance Under the UK’s Capital Requirements Regulations

The use of credit insurance by banks is a valuable but complex feature of the UK’s implementation of the Capital Requirements Regulations (UK CRR).  In this seminar, Browne Jacobson will review how credit insurance can be a useful prudential regulatory tool and consider the practical risks and opportunities when seeking to purchase, adhere to, and claim on credit insurance.  In addition, this session will help members understand the regulatory limitations on the use of credit insurance.

Why attend?

The use of credit insurance can be highly beneficial for banks. In particular, exposures to a borrower can be replaced with exposures to an insurer, thus reducing the capital ‘burden’ of a transaction or relationship.  However, the provisions of the UK CRR do not deal with credit insurance in a manner which is straightforward or readily correlated with the relevant insurance law and regulation.  For instance, the UK CRR provides for the use of ‘guarantees’ rather than insurance, but does not address how certain ‘guarantees’ are a form of insurance.
